Foundation setbacks are measured from the right of way line. Measuring from the edge of the roadway may cause you to remove a foundation resulting in a cost of several thousand dollars. The actual road might lie anywhere within the right of way. The Heritage Lake POA will not negotiate setback violations.

Building Restrictions

Building is not required but is restricted to single family dwellings on permanent foundations. Minimum square footage of living space on the main floor is 950 sq. feet. The Restrictive Covenants do not allow the placement of trailers or any similar type structures.

Placement shall be no closer than 30 feet to the front property line and/or the lake or no closer than 20 feet on any side street line. Side line easements are a minimum of 8 feet or 10 percent of the width of the property, whichever is greater.

Prior to any construction you must obtain the approval of the Architectural and Environmental Control Committee (contact through POA Office). A permit fee of $50 will be charged for a house application, $50 additions, detached garages, or boathouse, and $50 for all other structures, at the time of application. This money will be used to for follow-up location site inspection and to cover administrative costs. There is also a sewer fee on all home permits due to the Clear Creek Conservancy District, plus county permit fees.

Please contact the POA Office for the proper documentation necessary before any changes are made, whether during the initial building project or later improvement to your lot or home.
